Tesla stock is falling because NHTSA's audit of Cybercab's self-certification will almost certainly find it fails FMVSS 135, the rule requiring a human-usable brake pedal. Without self-certification the exemption path is capped by statute at 2,500 cars. The way out is a pending NHTSA rule modernising FMVSS 135 for driverless vehicles, which could take effect in October at the earliest but is far from guaranteed. Until then Tesla should prepare to scale Cybercabs with brake pedals. Bearish short term, but the long-term trajectory is unchanged. Tone rewrite only.
